Porter County Court documents, or court records, are records of the official actions taken in all Porter County trial-level court matters. In Porter County, Indiana, the majority of trial-level court matters are heard in the Porter County Circuit Court or the Porter County Superior Courts. These two courts are primarily responsible for storing and maintaining such records. Court documents are intended to provide a historical account of civil dispute resolution, criminal prosecution, family law matters, probate, and small claims, ensuring an open, transparent judicial process.

Court records are generated throughout the progression of each case. The clerks for the courts create original copies of the pleadings, motions, evidence, orders, and judgments in each case, and some court reporters also prepare transcripts of hearings and other court proceedings. The maintenance and public availability of court records are both governed by the Indiana Access to Public Records Act and by the rules of procedure established by the Indiana Supreme Court.

Are Porter County Court Records Public?

Most of the court records in Porter County, Indiana, are available for public inspection or copying under both the Indiana Access to Public Records Act and the Indiana Supreme Court’s Rules. Much of the case files from the Porter County Circuit Court and the local Superior Courts will be available for public inspection or copying.

In general, all civil case files, such as contract disputes and real estate issues, most criminal case files, small claim files, and probate case files are available to the public unless sealed by the court. There are, however, certain types of records that are protected by statute and or court rule from public disclosure to protect individual privacy and safety. Examples include juvenile delinquency case files, child protective services case files, adoption case files, and certain mental health case files.

Additionally, while family law case files are generally available for viewing or public inspection, courts will often redact personally identifiable information related to minor children and or other sensitive information contained within those files.

What Information is Available in Porter County Court Records?

The Porter County Circuit Court and Superior Court maintain court records of all steps taken in a case from its initial filing through its conclusion. The typical process for maintaining these documents begins with the docket or case summary. This record includes the names of the parties involved, the case file number, the date the case was filed, the name of the assigned judge, and a chronology of hearings and decisions in the case.

In addition to the above information, most files will include pleadings and motions filed by either party, such as a complaint, answer, petition, etc. In criminal matters, this information may include a charging information, affidavit of probable cause, a bail or bond agreement, and a sentencing order. Civil files typically include a contract, an affidavit, discovery information, and the final judgment entered in the case. Family law cases may include a parenting plan, a support order, and a stipulated agreement regarding property distribution.

Porter County Court Records Search

Searching for information about Porter County court proceedings can be done using one of several methods, depending on whether searchers want civil, criminal, or small-claims cases and how much information they need.

Online Access: Most civil, criminal, and small claims cases can be found via Indiana’s statewide Odyssey case management system. This allows users to view docket summaries and initial filings for cases filed with both the Circuit Court of Porter County and local Superior Courts. Juvenile, adoption, and some confidential family cases are not available online. Users may have to register to gain full access to all documents.

In-Person Access: If you wish to physically review a file, you can go to the Clerk’s office during regular business hours and use public access computers to find your case, or have a clerk help you locate it.

Phone and Mail Requests: When making written requests for copies of a document, you should include the case number, the parties involved, and an addressed, stamped envelope for returning the copies. There is a copy charge, and you may pay by money order or certified check.

Fees for Court Records in Porter County

In Porter County, Indiana, the cost to access your public court records is set by both State statute and local procedure. The cost of copying a court record in Porter County will be approximately $1.00 per page for a black-and-white copy of a standard-size document printed from the file. In addition to the cost of making a copy, if you need a certified copy of the document, there is an additional certification fee ranging from $5.00 to over $10.00. A certified copy is required for use outside the Court.

Basic searches and viewing of docket information through the online statewide case system are free. However, downloading or printing image copies of documents, or obtaining certified copies, may incur a per-page fee once the document has been retrieved.

Statutory fees are charged separately by the county for non-court records (such as vital statistics - births, deaths, marriages). Fees are $15.00 for the first certified copy of a birth or death certificate and lower amounts for subsequent copies.

The clerk accepts payment in the form of cash (in person), checks, money orders, and creditor debit cards with an associated processing fee.

Criminal Records Access in Porter County

Porter County has two major distinctions between a court case record and an official statewide criminal history report. Case records are maintained by each of the county’s courts for every individual case that is filed in Porter County, including felonies, misdemeanors, and traffic offenses. Each case record reflects the specifics of the case as it was prosecuted: charges, hearings, plea agreements, and the outcome.

A formal statewide criminal history report is compiled by the Indiana State Police and is not provided by the Porter County Courts. Employers, licensing agencies, or individuals requesting an official background check on a person must submit the request through the state’s reporting system, which aggregates arrest and disposition reports from various jurisdictions throughout the state.

Porter County case records are available for search through the Internet-based Odyssey portal provided by the State of Indiana. Searching the Odyssey portal will allow you to view a summary of the case dockets and some basic filings.

Porter County Probate Records

Porter County probate records document the court procedures used to settle a person’s property after their death and to protect those who must be supervised by the courts. Most estate records (probate) are processed through the Probate Division at the Porter County Circuit Court. Probate files can include wills, probate filings, trust matters submitted to the court, estates, guardianships for minor children or incapacitated adults, and conservatorships managing the finances of a person.

Probate files usually consist of the decedent’s last will and testament, petitions to open an estate, inventory of all of the assets, creditor claims, final accounting, and court order approving the distribution of the assets. Files from the court related to guardianships or conservatorships may contain a petition for appointment, a surety bond, an annual report, and a court finding. Some probate file summaries are available online, through Indiana’s statewide search system. Older case files, certified copies of records, or detailed documentation may require an in-person visit to the Porter County Clerk’s Office. Additionally, some probate files may be restricted from being reviewed due to court seals or confidentiality agreements.

Porter County Family Court Records

Porter County family court records detail all legal matters regarding responsibility for family members and their finances. Examples of matters addressed in Porter County family court include dissolution of marriage, custody or parenting time, child Support, paternity, protective orders, and adoptions.

Many summaries of divorce and support case documents in Indiana may be found online using the Statewide Odyssey Portal. Users will generally be able to search for and view docket entries, party names, and hearing dates. Many sensitive filings, such as financial declarations, Social Security Numbers, and minors’ records, will either have the information removed (redacted) or be blocked from public viewing. By statute, most Adoption Files and other Juvenile Matters are confidential and therefore cannot be viewed online.

Individuals wishing to review complete documents may go to the Clerk’s Office during normal office hours to obtain permission to review the file. There may be restrictions on older documents or exhibits. Certified Copies of Decrees or Custody Orders may be obtained by completing a Request Form, paying the applicable fee per page and for certification, and providing the case number to ensure accurate processing.

Federal Court Records in Porter County

Public access to federal case information is available from the Clerk’s Office at the appropriate U.S. District Court division during regular working hours. In addition, most federal court dockets and filings can be accessed electronically on the Internet through the Public Access to Court Electronic Records (PACER) system at a per-page cost. PACER is a national computer-based service that permits subscribers to access online case summaries, filings, and judgments of federal courts with certain exceptions due to privacy restrictions and sealing orders.

The Northern District of Indiana has three divisions: Hammond, Fort Wayne, and South Bend. Federal cases filed in Porter County are heard in the Hammond Division of the Northern District. The court handles all federal criminal charges brought against individuals in Porter County. It also handles civil rights complaints, appeals of bankruptcy decisions, and other civil litigation involving a federal law issue or parties from different states, provided the case meets jurisdictional requirements.
